Chatbot disclosure requirements under the EU AI Act: exact wording examples

What Article 50(1) requires

AI systems that interact with natural persons must inform those persons that they are interacting with an AI system, unless it is obvious to a reasonably well-informed person.

This applies from August 2, 2026.

When disclosure is required

Disclosure is required when:

• A chatbot handles customer queries
• An AI agent processes transactions
• A voice assistant handles calls
• An AI-powered email assistant responds to customers

It is not required when:

• A human is using AI as a tool to draft a reply (the human reviews and sends it)
• It is obvious to the user that they are interacting with AI

When disclosure must happen

At the latest at the first interaction. The safest approach is to disclose in the first message and maintain a persistent label throughout the conversation.

Example wording

Website chat widget (friendly)

First message:

"Hi! I'm [Company]'s AI assistant. I'm an automated system, not a human — but I can answer most questions instantly. Type 'agent' anytime to reach a person."

Persistent label:

"AI assistant — automated responses"

Voice assistant (formal)

Opener:

"You are speaking with an automated AI assistant for [Company]. This call may be processed automatically. Say 'representative' at any time to reach a person."

Email assistant

Signature:

"This message was generated by [Company]'s AI email assistant. A human colleague reviews and approves all responses."

Industry-specific additions

For healthcare-adjacent services:

"This assistant does not provide medical advice."

For financial services:

"This assistant does not provide financial advice."

Placement guidance

• Chat widgets: First message + persistent badge in the header
• Voice: Spoken disclosure at the start of the call
• Email: In the signature or first line of the response
• WhatsApp/Messenger: First message + profile bio indicating AI
